On 07.09.2017, no one was present on behalf of the appellant and the case was adjourned to 12.09.2017. On 12.09.2017, the situation was not different.

Today, learned counsel for the appellant has appeared and made a statement that she has no instructions as the file of the case was taken away from her.

Keeping in view the aforesaid facts, the appeal is dismissed for non-prosecution.

The application for restoration, if filed, shall only be entertained, subject to tentative costs of Rs.50,000/-.
