*** MANOJ BAJAJ, J. (Oral) Petitioner has filed this writ petition under Article 226 Constitution of India for issuance of a writ in the nature of certiorari seeking quashing of impugned Award dated 05.01.2022 (Annexure P-8) passed by the Industrial Tribunal, Patiala, whereby the application filed by the petitioner for claiming the recovery of dues to the tune of Rs.9,16,699/- was dismissed.

Learned counsel states that through the impugned award dated 05.01.2022, limited claim of recovery made by the workman under Section 33-C (2) Industrial Disputes Act, 1947, was declined as not maintainable by the Labour Court, for lack of any existing right. Learned counsel for the petitioner does not press present petition in order to avail the alternative remedy and prays for withdrawal of the same. The prayer is accepted.
