ARUN MONGA, J. (ORAL) Petitioner herein, interalia, seeks issuance of a writ in the nature of certiorari to quash selection of private respondent No.4, alleging it to be illegal as despitescoring equivalent 171 marks as per final selection list (Annexure P-6) and petitioner has been kept in the waiting list for the post of Deputy Ranger.

At the very outset, learned State counsel submits that though the petitioner has secured equal marks, but being younger in age, she would not fall in the selection zone in SC category. He further submits that vide resolution dated 25.09.2015 (Annexure R-3/1), in case of a tie, when two or more candidates are having equal marks, benefit has to be given to a candidate older in age.

The afore said defence taken by the learned State counsel has not been opposed either by way of affidavit or by filing any additional document. It appears that the petitioner was misled by wrong understanding that she being older ought to have been selected, whereas it is other way round. She being younger was rightly kept lower in merit as per applicable Rule/resolution.

In view of the above, no ground for interference by this Court is made out.
