NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the impugned transfer order dated 29.08.2024 (Annexure P-3) and for quashing the subsequent relieving order dated 06.09.2024 (Annexure P-5) issued by respondent No.3, arising out of impugned transfer order dated 29.08.2024 (Annexure P3). Further a writ of mandamus has been sought for directing respondent No.3 to allow the petitioner to continue at Pathankot in view of disability of the petitioner and the fact that only 10 months of the service has been left. Further prayer has been made to stay the operation of the impugned transfer order dated 29.08.2024 (Annexure P-3). CWP No.23749 of 2024 (O&M) On receipt of advance copy of the writ petition, learned State counsel had sought adjournment on 18.09.2024, for getting instructions from respondent No.2.
Today learned State counsel, on instructions from respondent No.2, submits that the impugned transfer order dated 29.08.2024 (Annexure P-3), qua the petitioner shall be reconsidered by the respondents within a period of two weeks from today. In view of the above, the instant petition has been rendered infructuous and the same is disposed of accordingly. In the meanwhile, the impugned transfer order dated 29.08.2024 (Annexure P-3), shall not be given effect qua the petitioner till the same is reconsidered.
