The petitioner has filed the instant petition for directions to the official respondents to decide his representations dated 06.09.2024 (Annexure P1) and 17.09.2024 (Annexure P2), respectively, and also to register an FIR under Section 310 of the Bharatiya Nyaya Sanhita, 2023. 2.

Notice of motion to respondents No.1 to 3 only. 3.

Mr. Eklavya Darshi, Deputy Advocate General, Punjab, accepts notice on behalf of respondents No.1 to 4.

As per contents of the petition, the petitioner has been subjected to cheating by the private respondents. The contents of the petition viz-a-viz representations dated 06.09.2024 (Annexure P1) and 17.09.2024 (Annexure P2), respectively, submitted before respondent No.2-Senior Superintendent of Police, Gurdaspur, would show that if the allegations are proved, a cognizable offence is made. In view of the above, learned counsel for the petitioner wants to withdraw this petition with liberty to seek remedy before the learned Area Judicial Magistrate.

In view of the above said stand of the petitioner, the instant petition is hereby dismissed as withdrawn with liberty to avail remedy before the learned Area Judicial Magistrate.
