(ORAL) Prayer in this petition is for grant of regular bail in FIR No.188 dated 18.11.2020 under Section 307, 336, 34 IPC and Sections 25/27/54/59 of Arms Act, registered at Police Station Gharinda, District Amritsar. Learned counsel for the petitioner submits that though the allegations against the petitioner are of causing injury to the victim by a firearm, however, the matter has already been compromised between the parties and in CRM-M-6476-2022, praying for quashing of FIR on the basis of compromise, notice of motion has been issued and learned counsel for the VISHNU 2022.02.17 16:25 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh.
In virtual Court CRM-M-244-2022 -2complainant has acknowledged that there is a valid compromise between the parties.
Learned State counsel has filed the custody certificate dated 16.02.2022 in the Court today, according to which, the petitioner is in custody for the last 10 months and 05 days.
After hearing learned counsel for the parties, without commenting anything on merits of the case and considering the fact that the petitioner is in custody for the last more than 10 months; he is not involved in any other case; investigation is complete and also in view of the fact that the matter has already been compromised between the parties, this petition is allowed and the petitioner is directed to be released on regular bail subject to furnishing his bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned.
Petition is disposed of.
