Petitioner has preferred this writ petition for issuance of an appropriate writ, order or direction especially in the nature of mandamus directing respondents No.2 and 3 not to cancel the election of the petitioner and other office bearers and allow the petitioner and others to conduct day to day affairs of the Society in the absence of the President, who had a tie between him and another candidate on the post of President. The decision of the result of the post of President is still pending. Notice of motion.

CWP No. 325 of 2022 -2On the asking of the Court, Mr. Vivek Chauhan, Addl. A.G., Haryana accepts notice on behalf of State of Haryana and submits that the respondents have not issued any notice of cancellation of election in any manner and the present writ petition is founded on mere apprehension.

At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case his legal notice dated 25.10.2021 in respect of other prayers be ordered to be decided by respondent No.3 in accordance with law. Prayer with regard to permission to conduct the affairs of the Society in the absence of President would be seen by respondent No.3 in accordance with law.

In view of aforesaid fact, this petition is disposed of with a direction to respondent No.3 to look into the grievance of the petitioner and pass an appropriate order on the legal notice dated 25.10.2021 in accordance with law, preferably within a period of one month from the date of receipt of certified copy of this order.
