The petitioner's suit for recovery of ₹4,00,000/- as principal amount along with the interest is pending before the Trial Court. He filed an application for permission to correct the printing/inadvertent error which has been rejected by the Trial court. In para 4 of the plaint, the petitioner has alleged that an amount of ₹4,00,000/- was paid to the defendants through the bank transaction on 04.11.2015, however, in para 7, he has inadvertently stated that the cause of action accrued in his favour on 29.10.2015 and not on 29.10.2018. The cause of action for filing the suit cannot arise before the amount was paid to the defendants.

It is evident that the Trial Court has failed to comprehend the controversy involved.

Keeping in view the aforesaid facts, the present revision petition is allowed and the impugned order is set aside. The plaintiff is DEEPAK KUMAR BHARDWAJ 2025.04.01 10:37 I attest to the accuracy and integrity of this document permitted to rectify the printing error.
