The present petition has been filed seeking quashing of FIR No. 471 dated 17.08.2024 under Sections 498-A, 323, 506, 406 and 34 of the Indian Penal Code, 1860 registered at Police Station Suraj Kund, District Faridabad (Annexure P-1), and all other subsequent proceedings arising therefrom on the basis of the compromise-cum-affidavits dated 20.05.2025 and 26.05.2025 respectively (Annexures P-2 and P-3). 2.

Learned counsel for the petitioner submits that the parties are living separately.

Learned counsel for the respondent has also submitted that the matter has been compromised between the parties. 3.

Be that as it may, a perusal of the affidavit demonstrates that the parties have deposed that they have no objection, in case, either spouse contracts the second marriage with another person. However, it is pertinent to note that neither divorce petition nor decree has been placed on record to demonstrate that parties have legally parted their ways. CRM-M-43031-2025 2 deposed that they will live separately. Therefore, considering the same, this Court cannot become a party to such unlawful and irregular undertakings of the parties.

Faced with the above, learned counsel for the petitioner prays for withdrawal of the present petition at this stage. 5.

In light of the above, the present petition stands dismissed as withdrawn at this stage, without expressing any opinion on the merits of the case.
