Present petition has been filed under Article 226 of the Constitution of India for directing respondents No.2 and 3 to protect the life and liberty of the petitioner from the hands of respondent No.4 as respondent No.4 is trying to involve the petitioner in false cases by saying that he got married to her. It is further prayed to issue direction to respondents No.2 and 3 to investigate the present case in impartial manner and to take action on the representation filed by petitioner against respondent No.4, on 30.08.2024, Annexure P-5.

Learned counsel for the petitioner submits that petitioner never performed marriage with respondent No.4, however, respondent No.4 has filed frivolous petition under Section 9 of the Hindu Marriage Act only to harass the petitioner. It is submitted that the marriage certificate produced by the petitioner is also forged as neither the petitioner performed marriage MEENU 2024.09.20 11:55 I attest to the accuracy and integrity of this document

CRWP-9079-2024 -2with respondent No.4 nor she signed the same. It is also submitted that photograph on the marriage certificate is also taken by respondent No.4 from the social media. She submits that petitioner is being harassed by respondent No.4 for which she has already filed a representation before respondent No.2-Senior Superintendent of Police, UT, Chandigarh, Annexure P-5, on 30.08.2024, however, no action has been taken on the same till date.

On asking of the Court, Mr.Virenjeet Singh Mahal, Addl.P.P.UT, Chandigarh, who is present in Court, accepts notice on behalf of the respondents No.1 to 3.

Without entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, I dispose of the petition with a direction to respondent No.2-Senior Superintendent of Police, UT, Chandigarh to decide the representation (Annexure P-5) of the petitioner expeditiously preferably within one month from today and take necessary action as per law if the situation so warrants.
