  "Instant petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 in FIR No.80 dated 17.11.2021, registered for offences under Sections 323, 325, 341, 379'B, 511, 148 and 149 of the Indian Penal Code, 1860, at Police Station Lakhewali, District Sri Muktsar Sahib (Annexure P'1).

+ Counsel for the petitioner contends that the petitioner has been falsely framed as he and co'accused, Amritpal Singh are brothers and sons of the present Sarpanch of village Lakhewali. He contends that the petitioner was not present at the spot and has been named as an after thought, which is apparent from the fact that the FIR has been registered four days after the alleged occurrence. He submits that the petitioner, who has unblemished antecedents, is ready to join the investigation and co'operate with the Investigating Agency. Notice of motion.

On asking of the Court, Mr. Randhir Singh Thind, DAG, Punjab accepts notice on behalf of the respondent'State. To be heard with CRM'M'51479'2021 on 09.02.2022. Meanwhile, the petitioner shall join the investigation and would appear as and when called for by the Investigating Officer. In the event of arrest, he shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. He shall also abide by the conditions as specified under Section 438 (2) Cr.P.C."
