Petitioner has filed instant petition under Section 438 of Cr.P.C./Section 482 of BNSS, 2023 for grant of anticipatory bail in FIR No.288 dated 02.09.2024 under Sections 21B/61/85 of NDPS Act, registered at Police Station Kalanwali, District Sirsa, Haryana (Annexure P-1) 2.
Learned counsel for petitioner argued that arrest of present petitioner was stayed by this Court vide order 17.09.2024 and relevant portion thereof runs as under:- "Petitioner - Gurmeet Singh has filed this petition under Section 438 of the Cr.P.C. (Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023) for grant of anticipatory
! bail to him in FIR No.288 dated 2.9.2024 under Sections 21B/61/85 of the NDPS Act, registered at Police Station Kalanwali, District Sirsa.
Learned counsel representing the petitioner argued that no recovery is to be effected from the petitioner. He has been named by co-accused- Divesh Kumar alias Babbu. Regarding involvement in other cases, learned counsel for the petitioner stated that as per his information, one case under NDPS was registered against him in which he has been acquitted. The petitioner is ready to join the investigation as and when required.

On asking of this Court, Mr.Kanwar Sanjiv Kumar, AAG, Haryana accepts notice on behalf of State. He seeks an adjournment to file status report.

In the meantime, arrest of petitioner is stayed subject to joining of his investigation."

He further argued that in compliance to the aforesaid order, he has already joined the investigation on 20.09.2024. No recovery is to be effected from him. He was nominated on the disclosure statement of coaccused- Divesh Kumar alias Babbu. Therefore, his anticipatory bail may be allowed.

Status report is filed in which it is confirmed that petitioner has joined investigation 20.09.2024.

Since petitioner has already joined the investigation, therefore, he is not required for any other purpose. He is still ready to abide by the terms and conditions of bail order. Considering the aforesaid factual
