***** HARSH BUNGER J. (ORAL) CRM-18033-2023 The present application is filed for placing on record short counter affidavit to the status report along with Annexure P-11. For the reasons mentioned in the application, the same is allowed and short counter affidavit and Annexure P-11 are taken on record, subject to all just exceptions.

CRM-M-50867-2022 Prayer in the present petition filed under Section 482 Cr.P.C is for issuing directions to respondent No.2 to depute any IPS level Officer to investigate the role of respondents No.5 to 10 in connivance with respondents No.3 and 4.

A fresh status report dated 25.05.2023 by way of affidavit of

-2Varinder Singh Khosa, PPS, Assistant Commissioner of Police, North, Amritsar on behalf of respondents No.1 to 4 is filed by the learned State counsel in Court today and the same is taken on record, subject to all just exceptions and copy of the same is supplied to learned counsel for the petitioner in Court today itself.

Learned counsel for the petitioner has referred to paras 3 and 4 of the fresh status report which reads as under: "3.

That it is submitted that the aforesaid pen drive (Annexure P/11) containing CCTV footage of the alleged occurrence was watched by Sub-Inspector Sushil Kumar, Incharge of Police Post Vijay Nagar of Police Station Sadar, Amritsar and it was found that the private respondents No. 5 to 10 had trespassed into house of the petitioner and had beaten the petitioner Leela Devi and her daughter Shikha and caused them injuries, for which the GD No. 21 dated 13.06.2022, under Section 323 IPC was registered at PP Vijay Nagar of PS Sadar, Amritsar.

That it is submitted that therefore after watching the aforesaid CCTV footage, which was produced first time on 23.05.2023 by the present petitioner Leela Devi, the statement of the present petitioner Leela Devi was recorded on 23.05.2023 and on the basis of statement of the petitioner Leela Devi and as per their MLRS, the case FIR No. 155 dated 23.05.2023, under Sections 452, 323, 506, 148,149 IPC, Police Station Sadar, Amritsar has been registered against the respondent Nos. 5 to 10 namely Judge, Harjit Kaur, Vicky, Gopi, Deepo and Monika, which is under investigation and it shall be completed expeditiously."

Learned counsel for the petitioner submits that in view of the aforesaid status report, he may be permitted to withdraw the instant petition with liberty to avail further remedies available to the petitioner in

-3accordance with the law.

In view of the submission made by learned counsel for the petitioner, present petition is dismissed as withdrawn with the liberty aforesaid.
