The respondent has not entered into appearance despite receipt of notice of the present transfer application. 2.

On 18.09.2024, the following order was passed:- "The applicant-wife has filed the present application for seeking transfer of the divorce petition, filed by the respondenthusband, pending in Family Court Sunam, District Sangrur and she seeks transfer of the same to the Court of competent jurisdiction at Baba Bakala Sahib, District Amritsar. It is submitted by the counsel appearing on behalf of the applicant that on account of the matrimonial discord, the parties to the lis are residing separate. The applicant is residing at Baba Bakala. The petition under Section 125 Cr.P.C., filed by the applicant, is pending in the Courts at Baba Bakala. Even, DEEPAK KUMAR BHARDWAJ 2024.11.08 10:40 I attest to the accuracy and integrity of this document the complaint under the Protection of Women from Domestic

Transfer Application No. 1143 of 2024 Violence Act, is pending in the Courts at Baba Bakala. The distance between Sunam and Baba Bakala, is about 192 kilometres.

Learned Family Court shall adjourn the case, beyond the date fixed by this Court."

In view of the above, the present transfer application is allowed and the case i.e. HMA/130/2024 titled as "Jaswinder Singh v. Simranjit Kaur" filed under Section 13 of the Hindu Marriage Act, 1955, is transferred from the Court of the Principal Judge Family Court, Sunam to the competent Court of jurisdiction at Baba Bakala Sahib, District Amritsar. The transferor Court is directed to forthwith remit the file to the transferee Court. The petitioner is directed to appear before the transferee Court on 03.12.2024.
