(ORAL) The appeal is at the instance of plaintiff against the concurrent finding of fact whereby while denying the discretionary relief seeking specific performance of agreement to sell dated 01.03.2007, both the courts below confined it to alternative relief. The appeal is accompanied by application seeking condonation of delay of 201 days. The reasoning assigned with regard to non-availability of the certified cannot be a ground for condonation of delay, in view of the law laid down by Hon'ble Supreme Court in Office of the Chief Post Master General and others Vs. Living Media India Ltd. and another 2012 (2) SCT 269. The appeal is dismissed on the ground of delay only.
