This is the petitioner's fourth attempt to get bail during the pendency of the trial arising from the FIR No. 178 dated 08.08.2019, registered under Section 22 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station City, Ferozepur, District Ferozepur. 2.

The learned counsel representing the respondent submits that the statement of ten prosecution witnesses, out of the total 11 which were proposed to be examined, have already been recorded and the next date of hearing is 01.09.2024.

It is evident that more than 90% of the prosecution evidence has already been recorded. Moreover, the petitioner is in custody for a period of four years and four months. Hence, it is not appropriate for the Special Court to give such lengthy adjournments. Keeping in view the aforesaid facts, the present petition is disposed of with the direction to the trial Court to fix a short date for recording the deposition of the remaining witness to be examined on behalf of the prosecution. The parties, through their learned counsel, are directed to appear before the Special Court on 22.01.2024 at 10.00 A.M.. It shall be the responsibility of the Senior Superintendent of Police, Ferozepur, to ensure the presence of Jatinder Singh, Assistant Sub Inspector, on the date to be fixed by the trial Court.
