    The petitioner seeks grant of anticipatory bail in FIR No. 59 dated 06.07.2024 under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Kathunangal, District Amritsar.

The petitioner apprehends his arrest in respect of the FIR in question and submits that he has been falsely implicated based on the statement made by co-accused, namely, Manpreet, under Section 27 of the Indian Evidence Act, 1872 (Section 23 of the Bharatiya Sakshya Adhiniyam, 2023).

No recovery has been effected from the petitioner but it is alleged by the prosecution that the petitioner is one from whom other two accused had purchased narcotic drugs i.e. 5 gram of Heroin from Manpreet Singh and 7 grams of Heroin from Akashdeep Singh and the same has been recovered. Learned State counsel informs that the petitioner has criminal antecedents of 5 cases, three under the Excise Act and two under Sections 326 Indian Penal Code etc. (118(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereas learned counsel for the petitioner does not dispute that trial of these cases constituting criminal antecedents is pending. 5.

Looking to the fact that custodial interrogation of the petitioner appears to be necessary in this case and the petitioner has criminal antecedents of five cases, no case for grant of anticipatory bail is made out. The petition stands dismissed.
