Legal representatives of deceased plaintiff Joginder Singh are in appeal directed against the judgment and decree dated 8.8.2016 passed by Additional District Judge, Hoshiarpur, whereby judgment and decree dated 28.1.2013 passed by Addl.Civil Judge (Sr.Div.)Dasuya decreeing the suit of the plaintiff for possession by way of specific performance of the agreement to sell dated 1.7.2004 in toto was set aside and alternative relief of recovery of Rs.40,000/- alongwith simple interest @ 6% p.a., was granted. Notice of motion is yet to be issued.

At the time of hearing,learned counsel makes a prayer for simpliciter withdrawal of the instant appeal.
