*** Sudhir Mittal, J. (Oral) Respondent No.5 had filed an application for restoration of a demolished water course and the same was allowed. Appeal filed by the father of the petitioner was dismissed. The orders were challenged by him by filing a civil suit which was ultimately withdrawn. The private respondents meanwhile, approached this Court vide CWP No.20625 of 2022 which was disposed of vide order dated 12.09.2022 directing respondent No.3 therein to decide the pending legal notice by passing a speaking order. Thereafter, the present writ petition has been filed with the grievance that notice for restoration of the demolished water course has been issued to the petitioner.
Learned counsel for the petitioner submits that the petitioner was not made a party in the application filed for restoration of the demolished water course and, thus, the orders passed in favour of the private respondents are not sustainable in law.
The argument is misconceived and deserves to be rejected outrightly as the appeal filed by the petitioner has been dismissed and no further challenge has been raised to the said order by him.
