(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/91/2025, titled 'Gagandeep Bindra Vs. Deepika Sharma', filed by the respondent-husband, pending in the Family Court (Camp Court) Mukerian, District Hoshiarpur and she seeks transfer of the same to the Court of competent jurisdiction at Ferozepur.

Upon notice issued, the respondent did not make appearance, despite service and as such, was proceeded against ex parte. Counsel for the applicant heard.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 28.11.2023, but no child was born from the said wedlock. However, on account of the matrimonial dispute, the parties are residing separate. The applicant is not having any source of earning. Even, she has filed the petition under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 i.e. MNT-125/45/2025, as well as the complaint under the Protection of Women from Domestic Violence Act i.e. COMA/93/2025, which are pending in the Courts at Ferozepur and the respondent is making appearance in both the said cases. The applicant has also filed a complaint for registration of FIR, under Sections 406, 498-A, 34 and 120-B IPC, which is pending inquiry before Senior Superintendent of Police, Ferozepur.

Considering the constrained circumstances, as pointed out by the counsel, more particularly, considering the very fact of the applicant not having any source of earning and two other litigations, arising from this estranged marriage, already pending in the Courts at Ferozepur, which are being pursued by the respondent and above it, considering the fact about the respondent, having not come forward to resist the application, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/91/2025, titled 'Gagandeep Bindra Vs. Deepika Sharma', filed by the respondent-husband, stands transferred from the Family Court (Camp Court) Mukerian, District Hoshiarpur, to the Court of competent jurisdiction at Ferozepur. The requisite record of the aforesaid

case be sent by the Family Court (Camp Court) Mukerian, to the District and Sessions Judge, Ferozepur.

Learned District and Sessions Judge, Ferozepur, shall assign the said petition to the Family Court, Ferozepur. Even, the parties are directed to appear before the Family Court, Ferozepur, within a period of one month from today onwards.
