Instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

Learned counsel for the petitioner - Jaskaran Singh, submits that the injury, declared dangerous to life was suffered by the victim, Sandeep Kumar, who has expired during the pendency of the proceedings. It is further submitted that a compromise has now been effected between the parties to the dispute, including the legal heirs of the deceased - Sandeep Kumar.

It is also submitted that the petitioner is one of the assailants and has been attributed the injury on the head of the deceased Sandeep JAWALA RAM 2026.02.27 20:24 I attest to the accuracy and authenticity of this document

In support of his submissions, learned counsel produces a copy of the order dated 01.12.2025 passed by the learned trial Court, wherein it has been recorded that, "Witnesses Sudesh Kumari and Karanbir Singh appeared and made statements that they have compromised the matter with the accused persons in this FIR and do not want to lead evidence. A quashing petition has been filed before the Hon'ble High Court and the same is pending. In view of the statements made, the said witnesses are bound down for 11.02.2026."

Copy supplied by learned counsel of the aforesaid order is taken on record.

Learned counsel further submits that the aforesaid witnesses did not appear on 11.02.2026, and the proceedings before the trial Court stand adjourned.

Since the petitioner is attributed the main injury and is specifically named in the FIR, and further, in the quashing petition based on compromise, no statement authenticating the factum of compromise has been recorded, this Court is not inclined to entertain the plea of bail qua the present petitioner.

Accordingly, the present petition stands dismissed. However, it shall be open to the petitioner to file a fresh bail petition, if any fresh cause of action arises. Pending miscellaneous application(s), if any, also stand disposed of.
