RAJESH BHARDWAJ, J.(ORAL) Prayer in the present petition is for quashing of order dated 20.09.2022, passed by learned Additional Sessions Judge, Special Court, Kaithal, (vide which the witness, namely, Rajpati, was wrongly given up and for recall of the witnesses) alongwith all consequential proceedings arising therefrom in case FIR No.390, dated 01.10.2020, under Sections 304-B, 406, 498-A, 34 IPC, registered at Police Station City Kaithal City, District Kaithal.

Counsel for the petitioner prays for withdrawal of the present petition with liberty to the petitioner to avail his remedy of filing an application under Section 311 Cr.P.C.

Allowed as prayed for.
