CRM-M-49021-2023 and connected cases 2024:PHHC:015121 KULDEEP TIWARI, J. (ORAL) 1.

Since all these petitions arise out of a common FIR, i.e. FIR No.115 dated 28.07.2023, registered at P.S. Sector 34, Chandigarh, besides when the relief claimed therein is also alike, vis-a-vis, grant of regular bail, therefore, all these petitions are taken up together for adjudication.

2.

Considering the fact that the investigation in the FIR (supra) has not yet been completed, inasmuch as, (i) some of the co-accused are yet to be arrested; (ii) one of the co-accused is residing abroad; (iii) one of the co-accused Shubham Jain, who was arrested while possessing the alleged contraband and who was granted relief of interim bail, has not restepped into the prison concerned, after expiry of the term of interim bail, therefore, at this stage, this Court is not inclined to consider the case of the petitioner(s) for grant of regular bail.

3.

Faced with the above situation, the learned counsels representing the petitioner(s) (in all the petitions) seek permission to, at this stage, withdraw the present petitions, however, with liberty to reaccess this Court, in case there occurs inordinate delay in conclusion of trial qua them.

4.

Permission granted.

5.

Consequently, all these petitions are dismissed as withdrawn. (KULDEEP TIWARI) February 05, 2024 JUDGE devinder Whether speaking/reasoned :
