ARVIND SINGH SANGWAN, J. (Oral) This is the first petition filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.29 dated 30.1.2019 under Sections 341, 365, 397, 506 and 34 IPC (Section 412 added later on) and Section 25 of the Arms Act, registered at Police Station City Ratia, District Fatehabad. Counsel for the petitioner submits that as per the allegations in the FIR, the co-accused have robbed victim Sukhvinder Singh of his car bearing registration No.HR-22G8898 along with mobile phone. He further submits that the petitioner has purchased the said car from the co-accused. Counsel for the petitioner further submits that it is a matter of trial as to whether the petitioner was having knowledge that it was a stolen car.

Counsel for the petitioner also submits that the recovery has already been effected and the challan has been presented and the trial will take some time to conclude. Learned State counsel, on instructions from the Investigating Officer ASI Ramesh Kumar has not disputed the SATISH KUMAR 2019.10.

Without commenting anything on the merits of the case, considering the aforementioned submissions made by the counsel for the petitioner, the recovery has already been effected and the trial is likely to take some time to conclude, this petition is allowed and the petitioner is directed to be released on regular bail, subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate, concerned.

However, it will be open for the prosecution to apply for cancellation of bail of the petitioner, in case he is found involved in any other case or misusing the concession of bail, in any manner.
