Dated Police Station Sections 06.09.2023 Civil Lines Gurugram, District Gurugram 306 & 34 IPC Seeking issuance of directions to the respondents to conduct free and fair investigation by considering the admitted documents already sent to respondent No.3 along with representation dated 15.09.2023 (Annexure P-23) before forming an opinion regarding the culpability of the petitioner in the FIR captioned above, petitioner has come up before this Court by filing the present petition under Section 482 r/w 163(2) CrPC.

Counsel for the State has handed over instructions, which are taken on record. He submits that the present petition filed by the accused, has become infructuous because till now investigation is not finding their involvement and the State is furnishing cancellation report.

Given above, let the State furnish cancellation report within two months from today. It is clarified that before accepting the cancellation report, concerned Court shall give appropriate opportunity to the complainant. Petitioner shall be at liberty to file protest petition in accordance with law and in case, the cancellation report is accepted, it shall be done by passing a speaking and reasoned order. 4.

Petition is disposed with the aforesaid observations. All pending applications, if any, stand closed.
