Delay of 50 days in refiling the appeal is condoned. 2.

A Civil Court intervention was simply not possible for correcting an adverse entry in ACR. The lower Appellate Court has observed that it will be open for the plaintiff to take appropriate recourse before the very same authorities who had made adverse entry and it will not possible for a Civil Court to make intervention unless a case of personal bias or mala fides, which had been neither pleaded nor proved. The statement of law is correct and it will require no intervention in the second appeal.

The second appeal is dismissed as involving no substantial question of law.
