After arguing vehemently at length and as an advance copy of this petition had been served upon Union of India, learned counsel for the Union of India has submitted that without commenting on the veracity of the allegations leveled by the petitioner, the same are covered under the provisions of Section 47 of the Army Act for which the petitioner will have to approach the competent authority.

Learned counsel for the petitioner disputes the said provision, however, is not averse to the fact that he shall approach the competent authority i.e. the CO for the relief so prayed. PARUL 2023.10.19 13:07 I attest to the accuracy and authenticity of this document

In light of the above, the present petition stands disposed of with liberty to the petitioner to approach the CO (Col. Prince Rohit) by filing a composite representation along with all cogent proofs and the same shall be looked into in accordance with law.

It is made clear that filing or pendency of this petition or any order/direction passed in this petition shall not be an alibi or defence to the petitioner, in case, he is found involved in any illegal activity and/or in violation of any law qua which the respondent-Authorities shall take appropriate action, in accordance with law.
