**** JASJIT SINGH BEDI, J. (Oral) On 11.08.2025, the following order was passed:- "The prayer in the present petition under Section 528 of BNSS, 2023 is for setting aside the order dated 28.07.2025 passed by the Additional Sessions Judge, Fatehabad in case No.SC-168-2021 titled as 'State vs. Bhavya and another' in FIR No.099 dated 28.02.2021 under Sections 401, 398 IPC and Section 25 of the Arms Act, 1959 registered at Police Station Tohana, District Fatehabad whereby the bail bonds of the petitioner were cancelled and arrest warrants for issued against him.

The learned counsel for the petitioner contends that on account of noting down of a wrong date, the petitioner was unable to appear on 28.07.2025 because of which the impugned order came to be passed. He states that the petitioner is ready and willing to join the proceedings once again.

Notice of motion for 29.09.2025.

In the meanwhile, the petitioner is directed to surrender before the Trial Court within a period of one week from today and subject to a deposit of Rs.25,000/- as costs with the Punjab and Haryana High Court Employees Welfare Association, A/c No.37167209613, State Bank of India, High Court Branch, Chandigarh, IFSC Code:SBIN0050306, he shall be admitted to interim bail to the satisfaction of the Trial Court.

CRM-M-43292-2025 -2A copy of the receipt depositing a sum of Rs.25,000/- with the aforesaid Association as well as a copy of the order granting interim bail to the petitioner be produced in the Court on the next date of hearing."

Thereafter on 08.09.2025, the following order was passed:- "The prayer in the present application under Section 528 of BNSS, 2023 is for extension of time to surrender before the Trial Court in terms of the order dated 11.08.2025 passed by this Court.

Heard.

For the reasons mentioned in the application, the same is allowed and the applicant/appellant is granted one week more time from today to surrender before the Trial Court in terms of the order dated 11.08.2025.

The application stands disposed of."

In deference to the aforementioned order, the petitioner has surrendered before the Trial Court and has been granted the concession of interim anticipatory bail vide order dated 12.09.2025 passed by the Additional District and Sessions Judge, Fatehabad. A copy of the said order is taken on record and marked as Mark 'A'.

In view of the above, no further orders are required to be passed by this Court.

It is expected that the petitioner shall not absent himself from the Trial without sufficient cause.
