**** HARNARESH SINGH GILL , J. (ORAL) The petitioners seek regular bail in FIR No. 03 dated 5.1.2019 under Sections 15/16 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Sadar Dabwali, District Sirsa. Learned counsel for the petitioners submits that he does not press the petition qua petitioner No. 1-Charan Singh alias Charna and the same may be disposed of as such.

Dismissed as not pressed qua petitioner No. 1-Charan Singh alias Charna.

As far as petitioner No. 2-Krishan Kumar is concerned, learned counsel for the petitioner submits that 100 kilograms of poppy husk was allegedly recovered from the accused. He further submits that petitioner No. 2-Krishan Kumar has been in custody since 5.1.2019. Learned counsel also submits that as far as other cases against petitioner No. 2-Krishan Kumar GURPREET SINGH 2020.02.18 11:26 I attest to the accuracy and authenticity of this document chandigarh are concerned, he is on bail in those cases.

CRM-M No. 43904 of 2019 -2Learned State counsel, on instructions from ASI Surjeet Singh, submits that in the present case, challan has been presented and out of 13 prosecution witnesses, 04 witnesses have been examined. Petitioner No. 2-Krishan Kumar has been in custody since 05.1.2019. Out of 13 prosecution witnesses, only 04 witnesses have been examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed qua petitioner No. 2-Krishan Kumar and he is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
