(ORAL) Grievance of the petitioner in the present case is for appointment of petitioner being dependent of deceased Ashwani Kumar, who though was working as Beldar since 1996 in the Department of Public Works Department (B&R), whose whereabouts were unknown since 16.07.2008. He was declared dead only in 2015. Accordingly wife of Ashwani Kumar submitted application (Annexure P-1) dated 17.07.2015 for payment of retiral benefits, which were sanctioned vide order dated 27.12.2016/09.01.2017 (Annexure P-4).
Learned counsel appearing for the petitioner submits that the Government has come out with notification dated 02.08.2019 extending the benefit of compassionate appointment to the wards of deceased employees. In this regard has already made a representation and sent a legal notice dated 08.08.2019 (Annexure P-6) and 02.09.2019 (Annexure P-7) respectively but no action has been taken.
Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct respondent No.2-Engineer-inChief, Haryana, Public Works Department (B&R), Plot No.1, Dakshin PANKAJ KUMAR 2019.10.24 10:50 I attest to the accuracy and integrity of this document
CWP No.29876 of 2019 (O&M) -2Marg, Sector 33A, Chandigarh to consider the representation and legal notice dated 08.08.2019 (Annexure P-6) and 02.09.2019 (Annexure P-7) respectively within a period of two months from the date of receipt of certified copy of this order and pass a speaking order thereon, failing which respondent No.2 shall be liable to pay costs of `25,000/- to the petitioner. This condition of imposing costs is only to prevent petitioner to run from pillar to post and avail remedy of contempt in case of non-compliance of directions issued by this Court.
