Nisha Verma v. Nitin Verma
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-123-2016 (O & M) Date of decision: 17.08.2016 Nisha Verma ....Applicant(s) V/s Nitin Verma
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. A.S. Khinda, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Jind to Mohali. It is urged before the court that proceedings under Section 125 Cr.P.C. are already pending at Mohali. Distance between the two places is almost 200 Kms. Besides, applicant has a minor child to look after. It would be difficult for her to defend the proceedings pending at Jind. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Jind be transferred to a court of co-ordinate jurisdiction at Mohali. The petition is allowed in these terms.
