***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Mandamus directing the respondent-Commission to consider the petitioner as eligible for appearing in the Common Eligibility Test (CET)-2022, Haryana for selection on Group C posts scheduled to be conducted on 05.11.2022 and 06.11.2022.

Petitioner is an aspirant for Group-C post against Advt. dated nil (P/1) to be conducted by way of CET examination. Pleaded case is that the web portal for recruitment was first launched in 2021 and he duly submitted his application (P/2) and made payment of the requisite fees (P/3 and P/4). However, the examination was later deferred. Finally, Advt. has now been re-published in 2022 and last date for registration was 08.07.22 and for payment of fees was 13.07.22. However, despite completing all steps the application form does not bear various details of the petitioner as against his successful payment details (P/6), and yet it is displaying status as 'fee not paid yet' (P/5). He met the officials qua his payment concern along with his Registration ID and other details, but to no avail.

I have heard the petitioner in person and having gone through the contents of the petition, it is rather deemed more appropriate if the petitioner first approaches the respondent-Commission, who shall take a decision, either way, in the matter. Petitioner is at liberty to file representation before the commission within 7 days from today, if not already filed. 5.
In the premise, given the nature of order being passed, there is no necessity to seek return by the respondent as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the petitioner to move a representation within a week before the respondent - Commission, who shall pass an administrative order, giving reasons thereof, in accordance with law. 7.
Let the needful be done as expeditiously as possible and in any case not later than 4 weeks from today.

In the meanwhile, the petitioner be allowed to participate in the CET, 2022 examination on provisional basis subject to the decision to be taken on his representation. Needless to say, in case any adverse orders are passed on the representation to be moved by the petitioner, he will be at liberty to challenge the same. Copy the instant order be given under signatures of the bench secretary.
