**** Rajan Gupta, J. (Oral) This is a petition under Section 24 of the Code of Civil Procedure seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Kapurthala to Hoshiarpur.

It is urged before the court that certain litigation is already pending at Garhshankar, District Hoshiarpur. Besides, the applicant has no source of income. Thus, applicant-wife would not be able to effectively defend the proceedings at Kapurthala.

Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act pending at Kapurthala be transferred to a court of co-ordinate jurisdiction at Hoshiarpur. The petition is allowed in these terms.
