This is a petition under section 24 of Code of Civil Procedure seeking transfer of proceedings initiated by husband-respondent under section 13 of the Act from the court at Karnal to Faridabad. Learned counsel for the petitioner submits that petitioner has no independent source of income and is dependent on her parents while respondent is employed as Technician. According to him, distance between two places is more than 150 kilometers. Besides certain litigation between the parties is already pending at Faridabad. Thus, it would be difficult for her to defend the proceedings at Karnal.

Plea for transfer has been opposed by counsel representing the respondent. He submits that it shall be in the interest of justice if aforesaid case is transferred to court of coordinate jurisdiction either at Sonepat or Panipat.

Keeping in view facts and circumstances of the case particularly that petitioner is a women, it is hereby directed that proceedings Ajay Kumar 2016.12.17 14:43 I attest to the accuracy and authenticity of this document
