(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.268 dated 11.10.2018, under Sections 323, 324 and 506/34 IPC, (Section 326 IPC added later on) registered at Police Station City, Tarn Taran.

Learned counsel for the petitioner submits that in pursuance of the directions issued by this Court vide order dated October 17, 2019, the petitioner has joined investigation. He further submits that RAJ KUMAR ARORA 2019.12.17 14:51 I attest to the accuracy and integrity of this document

CRM-M-43902-2019 (O&M) even otherwise, the role attributed to the petitioner was inflicting of dang blow on the back which is on the non-vital part of the body. Per Contra, learned State counsel, on instructions from ASI Surinder Singh, states that the petitioner has joined investigation and no further recovery is required to be effected in the present case. Heard the learned counsel for the parties.

Considering the totality of the circumstances and the fact that the petitioner has joined investigation and no further recovery is required to be effected in the present case, the present petition is allowed. Interim order dated October 17, 2019, is made absolute. December 16, 2019.
