IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-224-2016 (O & M) Date of decision: 17.08.2016 Sarika ....Applicant(s) V/s Gaurav
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Rajbir Singh, Advocate, for the applicant. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Hisar to Sangrur. It is urged before the court that proceedings under Section 125 Cr.P.C. are already pending at Dhuri, District Sangrur. Distance between the two places is almost 150 Kms. Besides, applicant is unemployed and is dependant on her parents. Due to financial constraints, it would be difficult for her to defend the proceedings pending at Hisar. Respondent remains unrepresented despite service. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act at Hisar be transferred to a court of co-ordinate jurisdiction at Sangrur. The petition is allowed in these terms.
