(Oral) This is a petition under Section 24 of the Code of Civil Procedure seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Chandigarh to Yamunanagar.
It is urged before the court that the applicant is facing financial constraints as she is dependent on her parents. Certain litigation is already pending at Yamunanagar. Besides, the distance between the two places is almost 100 Kms. Thus, applicant would not be able to effectively defend the proceedings at Chandigarh in absence of any support. Respondent has been served by way of affixation. He, however, remains unrepresented.
Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act pending at Chandigarh be transferred to a court of co-ordinate jurisdiction at Yamunanagar.
The petition is allowed in these terms.
