The present petition has been filed under Section 528 of BNSS for quashing of impugned order dated 28.10.2021 (Annexure P-3) passed by the learned Additional Civil Judge (Sr. Divn.), Tarn Taran in FIR No.13 dated 29.01.2020, under Sections 420/120-B of IPC, registered at Police Station Sirhali, District Tarn Taran (Annexure P-1) vide which the petitioner has been erroneously declared as proclaimed offender/person. 2.
Learned counsel for the petitioner contended that the petitioner has been declared as a proclaimed offender without following the due process of law as mandated under Sections 82 Cr.P.C. Mr. Ravinder Singh, Deputy Advocate General, Punjab, accepts notice on behalf of respondent-State and opposes the prayer made by learned counsel for the petitioner.

Keeping in view the contention of learned counsel for the petitioner that compromise with the complainant has been effected and the offences are compoundable in nature, the petitioner is directed to surrender before the trial Court on or before 25.09.2025 and if he surrenders before the trial Court and moves his application for bail before it, the same be considered keeping in view the fact that the main matter has been compromised and his application be decided in accordance with law. 6.
Disposed of accordingly.
