The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 1 and 2 to issue him passport.

The petitioner was issued passport on 11.07.1978. The petitioner was repatriated from Turkey on 01.10.1980. There was cost of repatriation. The respondents asked the petitioner to deposit the cost of repatriation which the petitioner has already deposited. FIR No. 164 dated 19.11.2012 was registered against the petitioner at Police Station Goraya, under Sections 420, 465, 467, 468, 471 and 120 B of IPC and Section 12 of Passport Act. The petitioner stands acquitted vide judgment dated 23.07.2018 qua different Sections of IPC but was convicted under Section 12 of the Passport Act. The petitioner stands released on probation. Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioner is directed to appear before the passport authority alongwith requisite documents on 19.10.2023. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks.

The petition stands disposed of.
