Surinder Gupta, J. (Oral) Learned counsel for the appellant submits that after decision of the appeal by Ist Appellate Court on 19.08.2015, defendant-respondent has passed order dated 22.08.2015, imposing punishment of dismissal from service on the basis of charge-sheet dated 30.08.2013.

As the order of punishment has been passed after decision of first appeal, plaintiff-appellant may pursue appropriate remedy available to him under the law against that order.

Learned counsel for the appellant seeks withdrawal of this appeal.

Dismissed as withdrawn with the observations that nothing observed in this case will come in the way of plaintiffappellant to seek appropriate remedy available to him under the law against the punishment order.
