(ORAL) Instant application under Section 24 of the Code of Civil Procedure has been filed seeking transfer of petition under Section 13 of the Hindu Marriage Act, 1955 (for short 'the Act') filed by respondenthusband from the Court at Patiala and petition under Section 25 of the Guardians and Wards Act pending in the Court of learned Civil Judge (Senior Division), Rajpura to the Court of competent jurisdiction at Karnal.
I have heard learned counsel for the applicant and perused the record.
Learned counsel for the applicant submits that he does not press for transfer of petition under Section 25 of the Guardians and Wards Act pending at Rajpura and confines his prayer only to transfer RAVINDER SINGH 2016.03.03 15:54 I attest to the accuracy and authenticity of this document
-2TA No.29 of 2016 the petition under Section 13 of the Act from Patiala to any other Court of competent jurisdiction.
Learned counsel for the respondent states that he has no objection if the petition under Section 13 of the Act is transferred from Patiala to Kurukshetra, to which learned counsel for the applicant agrees. In view of the consent given by learned counsel for the parties, application is allowed. Petition under Section 13 of the Act pending in the Court of learned Additional District Judge, Patiala, is ordered to be transferred to learned District Judge, Kurukshetra, who may assign the same to the Court of competent jurisdiction there. Learned District Judge, Patiala, shall ensure that entire record of the case is sent to learned District Judge, Kurukshetra. The parties are directed to appear before the learned District Judge, Kurukshetra on 21.03.2016. Disposed of.
