Mr.Saurabh Bajaj, Advocate, for the petitioners. Rajan Gupta, J (Oral) This is a petition seeking transfer of proceedings under Section 13 of Hindu Marriage Act and Sections 10, 12 & 25 of the Guardian and Wards Act from Karnal to Panipat. Respondent remains unrepresented despite service. It has been urged before this court that certain litigation is already pending at Panipat. It is stated that petitioner No.1 is unemployed and is dependent upon her parents. Even otherwise, proceedings under the Guardianship Act ought to have been filed at Panipat as custody of the child is with the mother (petitioner No.1 herein).
Keeping in view facts and circumstances of the case, it is directed that both the proceedings be transferred to the court of coordinate jurisdiction at Panipat.
