The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner vide application dated 24.02.2021 applied for passport. An FIR No. 108 dated 20.02.2010, under Section 171-C of IPC came to be registered against the petitioner at Police Station Sadar Patiala. The respondent on account of pendency of aforesaid FIR has not issued passport to the petitioner.

Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. PARAMJIT KAUR SAINI 2023.10.03 16:49 I attest to the accuracy and authenticity of this order/judgment

Learned counsel for Union of India, who on advance notice is present in Court, submits that the petitioner may be directed to appear before the passport authority alongwith requisite documents. Thereafter, the passport authority would pass an appropriate order after considering the afore-stated judgment within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioner is directed to appear before the passport authority alongwith requisite documents on 20.10.2023 at 10.00 a.m. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks.

The petition stands disposed of.
