(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Malout to Faridkot. It is urged before the court that certain litigation is already pending at Faridkot. Besides, the applicant has to look after two minor children. She has no source of income. Thus, it is not possible for the applicant-wife to effectively defend the proceedings at Malout. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Malout be transferred to a court of co-ordinate jurisdiction at Faridkot. The petition is allowed in these terms.
