Mr. Baljinder Singh, Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.86 dated 07.08.2024 under Section 61 of The Punjab Excise Act, 1914, registered at Police Station Bhikhiwind, District Tarn Taran. 2.
Learned counsel for the petitioner submits that in compliance of order dated 19.09.2024, the petitioner has joined investigation and cooperated with the investigating agency. 3.
Learned State counsel has filed status report by way of affidavit of Deputy Superintendent of Police, Sub Division Valtoha, Camp at Bhikhiwind, District Tarn Taran, which is taken on record subject to just exceptions.

Learned State counsel submits that although the petitioner has joined investigation and also cooperated with the investigating agency, however, it was pursuant to a secret information received qua the petitioner's involvement in illicit distilling of liquor that a raid was carried out and a recovery of 50 litres of lahan was recovered contained PUNEET SACHDEVA 2025.01.24 15:57 I attest to the accuracy and integrity of this document Chandigarh

On a pointed query put to the learned State counsel as to whether the petitioner's custodial interrogation is required, he, on instructions, has replied in the negative.

In view of the above, the petition is allowed and interim order dated 19.09.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
