**** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Ludhiana to Kapurthala. It is urged before the court that certain litigation is already pending at Kapurthala. Applicant has a seven months' daughter to look after and she is dependent on her parents. Besides, the distance between the two places is about 95 Kms. Thus, it would be difficult for the applicant-wife to effectively defend the proceedings at Ludhiana. No reply has been filed by the respondent despite opportunity given.
Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 13 of the Act at Ludhiana be transferred to a court of co-ordinate jurisdiction at Kapurthala. The petition is allowed in these terms.
