Suman Devi v. Sanjay Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH.
TA No. 389 of 2016 Date of Decision: August 17, 2016.
Suman Devi ....Petitioner
Versus
Sanjay Kumar .....Respondent
CORAM:
HON'BLE MR.JUSTICE RAJAN GUPTA
Present:
Mr.Robin Lohan, Advocate, for the petitioner. Rajan Gupta, J (Oral) This is a petition seeking transfer of proceedings initiated by respondent-husband under Sections 10 & 25 of Guardian & Wards Act from Panipat to Hisar.
Respondent remains unrepresented despite service. It has been urged before this court that proceedings would even otherwise lie at Hisar as both children are in custody of the petitioner-wife. Besides, petitioner is unemployed and has financial constraints. It is difficult for her to defend the proceedings at Panipat.
Keeping in view facts and circumstances of the case, it is directed that proceedings pending at Panipat be transferred to the court of coordinate jurisdiction at Hisar.
Allowed in above terms.
(Rajan Gupta) Judge August 17, 2016.
