(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Gurdaspur to Ludhiana. Respondent remains unrepresented. Efforts were made to effect service on him even through his counsel in the trial court but the same remained futile.
According to learned counsel for the applicant, another suit filed by the respondent-husband praying that the applicant be restrained from contracting second marriage has been transferred to Ludhiana in T.A. 405-2016. Besides, applicant has financial constraints. It would be difficult for her to defend the proceedings at Gurdaspur. Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Gurdaspur be transferred to a court of co-ordinate jurisdiction at Ludhiana.
