RAMESHWAR SINGH MALIK, J.(Oral) Learned counsel for the respondent submits that since the applicant has already been proceeded ex parte before learned trial Court, vide order dated 11.05.2016 and the said order can be set aside only by the same Court, instant transfer application would not be maintainable at the instance of the applicant.

Faced with the above, learned counsel for the applicant seeks permission of the Court to withdraw instant transfer application with liberty to the applicant to approach learned trial Court by moving an appropriate application seeking setting aside the order dated 11.05.2016, whereby she was proceeded ex parte, at the first instance. However, it is made clear that if necessity arises, applicant shall be at liberty to approach this Court again by moving appropriate transfer application. With the observations made and directions issued, present transfer application stands disposed of.
