$% !" # & '( ))))) H.S. MADAAN , J. (Oral) Aggrieved by the order, vide which the trial Court had closed his evidence, the plaintiff has approached this Court by way of filing the present revision petition.
Learned counsel for the petitioner has prayed that only one more opportunity be granted to the plaintiff to conclude his evidence. I have heard learned counsel for the parties besides going through the record.
A perusal of the impugned order goes to show that though the plaintiff has been highly negligent in not concluding his evidence in a case which is pending for more than 10 years but in the interest of justice to ensure that doors of justice are not shut upon him on a technical ground, one more opportunity is granted to him to conclude his evidence SUMIT KUMAR 2023.01.19 11:25 I attest to the accuracy and authenticity of this order/judgment
at his own responsibility, subject to payment of Rs.15,000/- as costs. The plaintiff would deposit the amount of costs in the Legal Aid Fund of District Legal Services Authority, Faridkot and then produce the receipt before the trial Court. The trial Court would afford him one effective opportunity for concluding his entire evidence, for which he will take dasti summons. Request for further adjournment shall be declined outrightly.
With such observations, the revision petition stands disposed of.
